Kountz Cheerleaders Win Banner Case

Wednesday, State District Judge Steve Thomas ruled that cheerleaders at Kountze High School can display banners containing Bible verses at football games.
The school district originally banned the practice because it was contacted by the Freedom From Religion Foundation who claimed it violated the section of the First Amendment that prohibits government from "endorsing" religion.
Back in October, Judge Thomas granted an injunction allowing the cheerleaders to continue the practice while they awaited the result of the lawsuit. The decision Wednesday allows the cheerleaders stated that the Kountze High School cheerleaders’ banners are constitutionally permissible, declaring that no law “prohibits cheerleaders from using religious-themed banners at school sporting events.”
Texas Attorney General Greg Abbott, referred to the ruling a “victory for religious liberties.”
The school district intends to appeal the decision.
This is the second ruling this week involving religion and football as earlier in the week the "Tim Tebow Bill" passed the Texas Senate. The bill referring to Tim Tebow, the former homeschooler that won the Heisman Trophy grants homeschooled athletes the right to participate in UIL sports at their local public school. The Congress will vote on the issue within a month.
